1. Introduction
These Terms & Conditions ("Terms") govern your access to and use of the DeliveryDost platform — a delivery marketplace operated by Finnid Infotech Private Limited ("Company", "we", "us"), a company registered under the laws of India with its registered office in Lucknow, Uttar Pradesh.
DeliveryDost is a product of Finnid Infotech Pvt. Ltd. and is accessible at deliverydost.in. By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
2. Definitions
- Platform — The DeliveryDost web application, mobile application, APIs, and all related services.
- User — Any person or entity that accesses the platform, including Enterprise Customers (EC), Business Centers (BC), Delivery Partners (DP), DP Cluster Managers (DPCM), Promoters, and Sub-Promoters.
- Delivery Partner (DP) — An independent contractor who fulfils delivery orders through the platform.
- Business Center (BC) — A business entity that creates delivery orders on the platform.
- Enterprise Customer (EC) — An end customer or business that uses the platform for delivery services.
3. Eligibility
- You must be at least 18 years of age to register on the platform.
- Delivery Partners must possess valid government-issued identification and, where applicable, a valid driving licence and vehicle registration.
- Business Centers must provide valid business registration documents (GST, Trade Licence, etc.) as required during onboarding.
- You represent that all information provided during registration is accurate, current, and complete.
4. Account & Registration
To use the platform, you must create an account by providing your mobile number and verifying via OTP. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorised access or security breach.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
5. Platform Services
DeliveryDost provides a marketplace connecting businesses that need deliveries with independent delivery partners. Key features include:
- 100% Bid Payout — Delivery Partners keep 100% of the delivery fee they bid. DeliveryDost does not deduct any commission from rider earnings.
- Bid-Based Delivery — BCs post delivery orders; DPs bid on them. The BC selects the winning bid.
- 5-Generation Promoter Cascade — Referral-based earning through promoter and sub-promoter networks.
- Welfare Fund — Contributions towards rider insurance and emergency support.
- Aggregator Hedge — Automatic routing to partner logistics providers (Delhivery, Borzo, Shiprocket, etc.) when no DPs are available.
- Wallet & Payout System — In-platform wallet for transactions, with payouts processed to linked bank accounts.
6. User Obligations
All Users:
- Comply with all applicable local, state, and central laws of India.
- Do not use the platform for any unlawful, fraudulent, or harmful purpose.
- Do not attempt to reverse-engineer, decompile, or interfere with the platform's functionality.
- Provide accurate and up-to-date information at all times.
Delivery Partners:
- Fulfil accepted deliveries in a timely and professional manner.
- Maintain required documents (licence, vehicle RC, insurance) in valid status.
- Handle all parcels and goods with due care.
- Do not transport prohibited or illegal items.
Business Centers:
- Provide accurate pickup and drop-off details for every delivery order.
- Do not ship prohibited, hazardous, or illegal goods.
- Ensure adequate packaging for goods being shipped.
7. Payments & Billing
- All payments on the platform are processed via CashFree payment gateway.
- Business Centers pay the delivery fee upfront, which is held in escrow until delivery confirmation.
- Delivery Partners receive payouts to their registered bank accounts as per the platform's payout schedule.
- Subscription plans (if applicable) are billed on a monthly or annual cycle with auto-renewal.
- All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
8. Cancellation & Refund Policy
- A Business Center may cancel a delivery order before a DP has accepted or picked up the order. Cancellation after pickup may attract a cancellation fee.
- A Delivery Partner may cancel an accepted order before pickup. Repeated cancellations may affect the DP's rating and account standing.
- Refunds, where applicable, will be processed to the original payment method within 7-10 business days.
- Disputes regarding deliveries must be raised within 48 hours of delivery completion through the platform's complaint system.
9. Intellectual Property
All content, trademarks, logos, designs, text, graphics, and software on the platform are the property of Finnid Infotech Private Limited or its licensors. You may not:
- Copy, modify, distribute, or create derivative works from any platform content.
- Use the DeliveryDost name, logo, or branding without prior written consent.
- Scrape, crawl, or use automated means to extract data from the platform.
10. Limitation of Liability
- DeliveryDost acts as a marketplace and is not a party to the delivery contract between BCs and DPs.
- We are not liable for any loss, damage, or delay caused by Delivery Partners during the course of delivery.
- We do not guarantee the availability of Delivery Partners at any given time or location.
- Our total liability in any matter arising out of these Terms shall not exceed the amount paid by you to the platform in the preceding 12 months.
11. Indemnification
You agree to indemnify and hold harmless Finnid Infotech Pvt. Ltd., its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from:
- Your use of the platform in violation of these Terms.
- Your violation of any applicable law or regulation.
- Any dispute between you and another user of the platform.
12. Privacy
Your use of the platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the Digital Personal Data Protection (DPDP) Act, 2023.
13. Dispute Resolution
- In the event of any dispute, both parties shall first attempt to resolve the matter through good-faith negotiation within 30 days.
- If unresolved, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Lucknow, Uttar Pradesh.
- These Terms are governed by and construed in accordance with the laws of India.
- The courts of Lucknow, Uttar Pradesh shall have exclusive jurisdiction.
14. Modifications
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notification.
15. Termination
We may suspend or terminate your account at our discretion if you breach these Terms. Upon termination:
- Your access to the platform will be revoked.
- Any pending payouts will be processed as per the platform's payout policy.
- Provisions relating to intellectual property, limitation of liability, indemnification, and dispute resolution shall survive termination.
